SAN DIEGO — A Black man is suing San Diego Police Department for racial profiling after officers pulled him over and smashed his car window during a traffic stop.

Nicholas Hoskins told news station CBS 8 he was heading to pick up his son when he was pulled over by police for allegedly running a stop sign on May 9.

During the stop, officers told Hoskins they wanted to search his vehicle. In the video, Hoskins can be heard asking for probable cause, and explaining to the officers he was a law-abiding taxpayer who was not on parole after the officers told Hoskins to get out of the vehicle. In the video, glass breaks on the passenger side of the car as the window is being smashed.

Hoskins accused SDPD of excessive force, illegal search, and unlawful arrest.

He told CBS 8 he stayed calm and complied because he was afraid the situation could have turned deadly.

Law firm McKenzie Scott is representing Hoskins in his lawsuit.
