Virginia Department of Corrections sued for keeping inmates from early release

The Virginia Department of Corrections is facing a lawsuit for wrongful imprisonment due to recent legislation that allowed prisoners with certain offenses, including violent offenses, to earn credits for early release.

However, some prisoners’ releases were delayed after they were already told they were eligible for early release.

The law took effect July 1, 2022 when many of the prisoners originally expected to get out.

The legislation however ended up being disputed in the Virginia state Supreme Court because inmates with convictions for attempted violent crimes, such as attempted robbery, for example, were not being granted release.
