CIRCLEVILLE, Ohio — A prosecutor has reportedly asked a judge in Ohio to dismiss charges against a Black truck driver who was attacked last month by police K-9 after video showed the man surrendering.

Prosecutor Jeffrey C. Marks said there wasn’t sufficient evidence to prove, beyond a reasonable doubt that the man, identified as 23-year-old Jadarrius Rose, caused a substantial risk of serious physical harm to people or property with his truck, according to The Associated Press.
Prosecutors said they may want to file charges again later if there was substantial risk, the AP reported.
Video of Rose’s arrest on July 4 near Circleville was recorded by police body cameras. Circleville is located about 30 miles south of Columbus.
State troopers can be heard in one of the videos shouting for Circleville Police Officer Ryan Speakman to restrain the K-9 while Rose was surrendering on his knees with his hands in the air but the dog attacked Rose. Rose, who was unarmed, was injured and had to be treated at a hospital.
After the incident, the officer was placed on leave and fired two days later from Circleville police.
