JACKSON, Miss. — A mistrial was declared on Thursday in the trial of two white men, a father and son, charged with attempted murder after allegedly chasing and shooting at a Black FedEx driver last year in Brookhaven.

Judge David Strong said he declared a mistrial due to errors by a detective with Brookhaven Police Department.
On Wednesday, Strong ended the court hearing early after Detective Vincent Fernando acknowledged that he had not given prosecutors or defense attorneys a videotaped statement that D’Monterrio Gibson, the FedEx driver, provided police after the alleged shooting. Fernando made the statements while the jury was out of the courtroom while he was under oath, according to the Associated Press.
Strong also said officers did not properly testify about guns found in the home of one of the men on trial and shell casings found outside the home.
Strong said he had no choice but to grant the defense attorney’s request for a mistrial.

The incident allegedly happened Jan. 24, 2022 in the city of Brookhaven, about 50 miles south of Jackson when Gibson, now 25, was delivering packages while driving Hertz van rented by FedEx.
Gibson delivered a package to an address at a residence belonging to one of the Cases when one of the two men attempted to block Gibson’s truck from leaving by using his own vehicle. Brandon Case allegedly stood in the street with a firearm and allegedly fired multiple shots at Gibson’s vehicle as he drove away. The father and son pursued Gibson’s vehicle to I-55, and case allegedly fired multiple shots into Gibson’s vehicle.
Gibson was not injured.
The Cases said they were protecting their property when the incident occurred.
Gibson’s attorney, Carlos Moore, previously compared the incident to the killing of Ahmaud Arbery in 2020.
Both men turned themselves into authorities on Feb. 1, 2022 and were released on bond the same day.
Moore said the mistrial “represents not just an administrative setback but also a delay in justice for Mr. Gibson and his family.”
Moore also said he has asked the U.S. Department of Justice’s Civil Rights Division to investigate the Brookhaven Police Department for misconduct.
