The 18-year-old man charged with shooting and killing 10 Black people and wounding three others in Buffalo, New York in May could reportedly face the death penalty.
Federal prosecutors may pursue the death penalty for the White supremacist accused of gunning down innocent people at a Buffalo grocery store as part of a racially-motivated attack.
Last month, survivors and family members of some of the victims killed reportedly met with the U.S. Attorney General about the case.
The suspect is facing 26 federal charges, including 10 counts hate crime.
The AG said the suspect targeted the grocery store because he knew many Black people shopped there.
The death penalty in this case will be a test for the Biden administration. Although he pushed for equity in justice during the 2020 presidential campaign, Biden said he opposed the death penalty.

Opinion: The death penalty is controversial but this case sends a signal that the ultimate consequence for mass shootings is not off the table for anyone, even if the crime took place in a state that does not have actively execute people for violent crimes.
